Returning to Constitutionalism’s Contractarian Roots Amidst the New Ideological ‘Cold War’

This talk draws on a unique Polish project in which 130 leading intellectuals—ranging from mainstream liberals to supporters of the right-wing Law and Justice government, itself sanctioned by the EU for rule-of-law breaches—engaged in a structured debate on the possibility of a constitutional compromise. The resulting volume, Let’s Agree on Poland, became a non-fiction bestseller and is now available in English from Oxford University Press. The lecture will explore what this intellectual experiment reveals about the role of lawyers in mediating between liberalism and the New Right. Arguing that today’s ideological cleavages echo those between democracy and Marxism in the last century, Prof. Kisilowski will suggest that reviving constitutionalism’s contractarian foundations may offer one of the few viable frameworks for coexistence across deep divides.
